Notice from Trustees regarding letter dated 4/20/2010 – 7/6/2010

On April 20, 2010 The United States Gypsum Asbestos Personal Injury Settlement Trust (“Trust”) sent out letters notifying claimants that the Trust proposed reducing the payment percentage applicable to claims against the Trust from 45% to 35%.  This re-determination of the payment percentage was proposed to the Trust Advisory Committee and the Future Claimants’ Representative of the Trust, as required by the Trust Agreement.  During the pendency of the consent process, the payment percentage for the Trust will be 35%.  The letter also stated that the Trustees have instructed the Delaware Claims Processing Facility to apply the 45% payment percentage to all claims where the Trust received all documentation, including releases, prior to 11:59 p.m. eastern daylight time on April 19, 2010.  Since that time, for all other claims, offers and payments have been made at the proposed 35% payment percentage.  To the extent you believe that claims which have now received an offer or payment at the proposed 35% payment percentage should qualify to be paid at the original payment percentage of  45%, please submit in writing a list of the claims by claimant name and claim number, together with an explanation as to why the law firm believes that the claim should be classified differently. The submissions should be sent to Trust counsel at Campbell & Levine, LLC, attention Philip Milch (pem@camlev.com). The Trust will advise the law firm of its decision in a timely manner.
